AUCTION HOUSE TERMS AND CONDITIONS

1. Only SA residents who are 18 or older may use the Jacks Daniel's Auction House (“the Auction House”). The following are prohibited from participating in the promotion:

a: a director, member, partner, employee or agent of or consultant to a Promoter; or
b: a spouse, life partner, parent, child, brother, sister, business partner or associate of a Promoter.

2. The Auction House will be open until 1 June 2010

3. New Auction House prizes will be announced from time to time and made available for auction on the website www.jackdanielsauction.co.za and www.jdauction.mobi

4. To bid for a prize, you will need to open an account at the website or mobisite and collect Jack Dollars. Jack Dollars may be obtained as follows:

• Register on the JD Auction Site – on registration, your account will automatically be credited with 20 Jack Dollars

• Buy a specially marked bottle/pack at your local store, locate the unique number and enter it on the website or mobisite to obtain 50 Jack Dollars. You may obtain a maximum of 200 Jack Dollars in this way.

• If you are a registered account holder at the website or mobisite, and you open an e-mail from us, your account will automatically be credited with 2 Jack Dollars.

• Login to the website - if you are a registered account holder at the website or mobisite, and you login sometime in September, your account will automatically be credited with 2 Jack Dollar (maximum of 10 logins awarded dollars per month – and one login awarded per day)

• Update your details - if you are a registered account holder at the website or mobisite, and you update your details sometime, your account will automatically be credited with 5 Jack Dollars (maximum of 1 update per month

5. When an item is posted and made available for auction, the auction start time and end time will be posted. All registered users may bid on the item up to the maximum number of Jack Dollars in their account

6. The winner of each auction will be the user having the highest outstanding bid at the end date specified for each auction. [Please note that the Promoter may extend individual auction periods at its discretion. If you have bids outstanding in an auction, please continue to check the status of the auction and to monitor the end-time specified.]

7. Stocks of prizes are limited and availability of all items cannot be guaranteed. The Promoter reserves the right to award prizes of equal or greater value in the event that stocks of a particular prize are reduced to zero.

8. Prizes are non-transferable and there is no cash alternative. Jack Dollars have no monetary vale and cannot be exchanged for cash.

9. The prize fulfillment will be conducted by Sauce-ing. Prizes should reach the recipients within 6 weeks of the closing date of the promotion.

10. Prizewinners may be required to participate in future publicity. If so required to participate in promotion, endorsement or advertising, prize winners undertake to furnish their consent to such promotional activities in writing to the Promoter.

11. Any consumer caught illegally redeeming URN's for which they have not made a valid purchase for will stand the chance of being banned from the Jack Daniel's Auction House Programme at the discretion of the promoter.

12. The Lucky Draw is a chance to win. It is not a bidding environment. By buying a chance for $20 you are agreeing to spend this amount. The $20 will NOT be credited back to your account if you are not the Lucky Draw winner.

13. By entering this competition, you are giving Jack Daniel's permission to communicate with you in the future regarding Jack Daniel's products, competitions, promotions and events. If you would like to opt out from this you can do so by sending an email to Jack_Daniels@lynchburg.jackdaniels.com with unsubscribe in the subject line.

14. All consumer data collected from this competition will be held by Brown-Forman Corporation (“BFC”) in Louisville, KY (USA).

15. The Promoter's decision in relation to all aspects of the competition is final and no correspondence will be entered into.

16. The Promoter reserves the right to withdraw or amend this promotion in the event of any unforeseen circumstances outside its reasonable control.

17. The Promoter reserves the right to cancel, terminate or temporarily suspend this promotion in the event of technical or any other difficulties, with no liability to any entrants, the prizewinner or any third party.

18. This promotion and these terms are governed by South African law and subject to the exclusive jurisdiction of the South African Courts.

19. Entrants are deemed to have accepted these terms and conditions by participating in this promotion.
